(a) A person whose legal rights are affected by these rules may petition the Board of Driver Services to enact, amend, or repeal any rule pertaining the primary responsibilities of the Department as set forth in O.C.G.A. § 40-16-2.
(b) The petition must set forth the proposed new regulation or amendment, or identify the rule for which repeal is sought and the reasons therefore. In addition, the petition must include the petitioner's name and address, and a statement of their interest in the matter. The petition shall be sent by certified mail, return receipt requested, addressed to “Legal Services, Department of Driver Services, P.O. Box 80447, Conyers, Georgia 30013.”
(c) Within thirty (30) days after receipt of such petition, the Board of Driver Services shall make reasonable efforts to deny the petition in writing, stating the reasons for the denial, or to initiate rulemaking proceedings in accordance with O.C.G.A. § 50-13-4.
